Italian court orders video portal Dailymotion to pay damages of EUR 5.5 mln to Mediaset

Mediaset announced that it has won a first legal battle against Vivendi’s online platform Dailymotion, which was accused of hosting copyrighted content without authorisation in an ongoing dispute going back to 2006. The court ordered Dailymotion to pay Mediaset EUR 5.5 million in damages, plus EUR 100,000 towards legal costs. It also imposed an additional penalty of EUR 5,000 for each day that the copyrighted content remains on the platform.
The dispute centres on 995 videos posted on Dailymotion in breach of copyright, and the court ruling comes after six years of legal proceedings. Mediaset said that the portal has continued to ignore its requests to remove copyrighted content over the years, forcing it to start seven separate court cases. The company believes that if the further six rulings go in its favour, it could expect total compensation in excess of EUR 200 million.
